Take notice that pursuant to Sections 34 and 36 of the Planning Act , the Corporation of the Town of Milton has received a Zoning By-law Amendment application requesting the removal of a Holding (H) symbol. An “H” holding symbol is a mechanism to ensure that certain conditions are met prior to the development of the lands proceeding in accordance with the approved Zoning. If the conditions are met, the Town is required to remove the holding symbol upon application by the landowner, by passing a By-law under Section 36 of the Planning Act .

Council intends to pass an amending by-law to Zoning By-law 016-2014, as amended, at its regular meeting scheduled on May 11, 2026 at 7 p.m. The meeting will be held both in person in the Council Chambers of the Municipal Offices, 150 Mary St., Milton and virtually.

Purpose and effect

“H82”shall not be removed until:

An updated Noise Study, Stormwater Management Report (including identification of the Low-Impact Development and Bio-Retention areas), Grading Plan, Functional Servicing Report, Hydrogeological Report, and Geotechnical Report has been submitted and approved to the satisfaction of the Town of Milton;

The owner undergoes an assessment of Sixth Line in support of the proposed truck access to the site, but not limited to, a geotechnical analysis (structural integrity), updated entrance width, radii and truck-turning movements, to the satisfaction of the Town of Milton.

A Site Plan and Landscape Plan has been provided demonstrating an enhanced level of berming and/or landscaping and urban design along Derry Road, to the satisfaction of the Town of Milton; and,

The owner provides updated Phase One and Phase Two Environmental Site Assessments (ESA) reports in accordance with O. Reg. 153/04 and the Region’s Protocol for Reviewing Development Applications with Respect to Contaminated or Potentially Contaminated Sites, to the satisfaction of the Region of Halton.

The effect of this application is to remove the Holding Provisions and permit development on the Subject Property.
